A Bus Driver from Blackheath has received £6,000 compensation after being injured at work. Unite, Britain’s largest union have secured this award for Stephen Jacobs with specialist personal injury solicitors, Pattinson & Brewer.
Mr Jacobs left the bus garage and drove his bus to the Bromley North Terminal and prepared his bus. Before his bus was due out at 6.15am, he visited the toilets near the canteen. He went into the corridor and after taking one or two steps his foot slid from under him due to the wet floor. He put his left hand out to save himself, but he hit the doorframe of the canteen door dislocating his left little finger and suffered a soft tissue injury to his left hand.
Mr Jacobs, continued
“I dropped my cash tray and when I tried to pick it up I felt a lot of pain in my left finger. The floor was wet as it had just been cleaned. There were no warning signs in place to warn anyone that the floor was wet. I had to go to the Princess Royal Hospital and was given gas and air whilst my finger was pushed back. My fingers were strapped together for 6 weeks and when the strapping came off, I could barely move my fingers and had to have physiotherapy to help me to move my little finger again.”
Representing Mr Jacobs, Deborah Smith from Pattinson & Brewer Solicitors explained:
“Cresswell Office Services Limited strenuously defended the claim and settled just 2 weeks before the trial was due to be heard. They claimed the floor was dry, as their cleaner had removed the signs once the floor had dried, blaming wet weather. Given the overwhelming evidence in support of my client’s claim, this is a difficult argument to comprehend. I am pleased that Mr Jacobs has finally been awarded the compensation to which he was clearly entitled.”
Mr Jacob’s Branch Secretary, Andy Clarke said:-
"The union is there to protect its members in the workplace and without the backing of the union this member would not have been able to stand up to the insurers and win this case.”
