A Maidstone man has been paid £517,500 compensation following an accident at work. The injury was so severe he required a knee replacement operation. The compensation payment was obtained by Unite the Union through its specialist personal injury solicitors, Pattinson & Brewer.
Glyn Davies, aged 62, was working as a warehouseman at the company’s Dickley Lane, Denham site when he was injured in November 2002. He was engaged in dismantling and re-erecting large industrial racking systems. Whilst he was re-erecting the racks, they gave way due to a lack of securing bolts and Glyn fell backwards, severely damaging his leg.
Glyn says:
"I was taken to Maidstone Hospital. I underwent a total knee replacement operation which forced me to remain in hospital for seven weeks. Since the first operation, I have undergone further surgery and I will require another two knee revisions and ongoing medial care. This catastrophic injury has affected most aspects of my life. The injury has meant that my wife has had to care for me by helping me wash, dress and clean my wounds. I cannot do any of the household jobs that I used to and I have not been able to return to work since my injury." Unite the Union partner, Niamh O’Brady from Pattinson and Brewer Solicitors, represented Mr. Davies and comments: "This serious injury came about because Mr Davies was operating equipment in circumstances where he had no training and which was faulty. There is even a question mark over whether the racking had ever been checked for safety during the fifteen years since it was first installed. The compensation is for the pain and suffering he has had to endure, as well as for lost income, loss of pension, past and future care and housing adaptations." Unite Regional Secretary, Andy Frampton says: "Mr Davies has won the right to return to the High Court to secure a further award of damages if he suffers a deterioration in his condition leading to knee fusion or amputation. Mr Davies injuries were caused by avoidable breaches of health and safety regulations for which there can be no excuse. His case was funded by the union’s legal scheme and therefore Mr Davies will suffer no deduction from his damages. This case shows the value of being a trade union member."
