Marcus Weatherby is a partner in Pattinson & Brewer's Accident and Disease department. He is a member of the firm's Industrial Disease and complex cases teams and has a wide experience of all types of accident and disease including:

Marcus's wide ranging experience covers many different types of clients and work including, amongst others, Unions (CWU, TGWU, PCS, GMB, TGWU, UNIFI and FBU) and their members as well as charities and private client cases. He has also advised Unions on health and safety negotiations with employers.

Amongst a wide variety of cases Marcus has achieved several positive results for clients in extremely complex cases:

  • A £250,000 settlement in a severe post traumatic stress disorder claim with ‘delayed reaction and symptoms’
  • He has successfully pursued a brain injury case and secured his client as a patient of the of Court of Protection
  • He has worked on a civil claim against Local Authority for effects of low level carbon monoxide exposure over a period of time
  • He has been successful in a claim for Psychiatric injury of Somatoform disorder as a result of accident at work.

In addition, Marcus has taken many cases to the Court of Appeal. He has taken two cases in particular to appeal that have set important precedents and won both:

  • WILLIAM PERCY ANDERSON v NEWHAM COLLEGE OF FURTHER EDUCATION (2002)[2002] EWCA Civ 505CA (Civ Div). This case establishes that there cannot be 100% contributory negligence and also interprets Workplace Health Safety and Welfare Regulations 1992.
  • SECRETARY OF STATE FOR SOCIAL SERVICES v JOHN JOSEPH DAVIS: [2001] EWCA Civ 105. Established interpretation of welfare benefits legislation in favour of Forestry workers.

Marcus is a member of APIL and is closely involved with the Charity CO Gas Safety, a charity lobbying and campaigning to improve health and safety in relation to carbon monoxide. He has also written a number of articles for industry journals including 'Does Trauma trigger multiple Sclerosis?' Hospital Medicine, Nov. 2003 and 'Pre-action Disclosure,' Journal of Personal Injury Law J.P.I. Law (2005) No.2.

He is an enthusiastic but often disappointed supporter of Stoke City Football Club and is keen on sailing and squash. He plays the piano (very well according to colleagues) and in addition to speaking Spanish, claims to have completed the Three Peaks challenge in 24 hours.
